THE FURTHER ADVENTURES OF LUKE AND JAKE
Chapter 11
Before he had left America, Scott Johnson had contacted the Police team that were investigating the attack on Jake and had arranged with the Victim Support Officer, Claire Robson, to meet with them for an update. Luke and Jake were still in bed at the time Scott left for the local Police Station, so he asked Molly to tell them what he was doing when they finally appeared for breakfast. The American knew that he would probably not learn anything new from the meeting, but it would give him an opportunity to satisfy himself that everything possible had been done and to thank the investigation team for their efforts. Molly told the two teenagers where Scott had gone and, as they had both arranged to have the day off work, they rushed through breakfast and hurried down to the town to meet Jake's dad. They arrived outside the Police Station just as Scott was coming out and ran towards him.
`Hi, guys. Let's go for coffee somewhere, I've got some news!'
Once settled in a local café, the teenagers eagerly awaited what Jake's dad had to say. It appeared that, when the the three young men that had been accused of the attack had appeared in Court, they had not entered a plea before being remanded in custody. Consequently, they were due to attend a second hearing at the end of the week, at which they would be required to enter their plea and any application for Bail would be heard. Scott had received an assurance that Claire Robson would be in touch with Jake about the procedure. No evidence would be heard so, if he wanted to attend, he would be free to do so, but the decision would be left to the American teenager. Unfortunately, Scott would not be able to be present as he was required back in America, but he was sure that Luke, Molly and Robert would be happy to be to support Jake whatever decision he made. Having heard what Scott had said, the young American told his dad that he was pleased that the case was moving forward, and Luke added that he would want to go to the hearing if Jake decided to attend and wanted him there adding that he would ask Brian, his boss, for time off.
Luke was sensitive enough to know that it would be a good idea to let Scott and Jake spend some time together without him and so he made the excuse that he needed to talk to Brian about the possibility of having time off to attend the Court hearing with Jake. He also needed go home and give his parents the latest news. Scott gave the British teenager an appreciative nod and Jake also mouthed a `thank you' to his boyfriend. Just as Luke was leaving, Scott said,
`I have a great idea. Why don't we all go out for dinner tonight, my treat? Perhaps, your parents might suggest somewhere? I'm hoping Jake will introduce me to his latest employer before we go back to the house.'
After kissing his boyfriend, Luke left to go to the leisure centre. When Brian saw him, he called out,
`I thought you had the day off, today!'
`I do, but now I've got another favour to ask.'
When the senior coach heard the reason for Luke's request, he readily agreed but added that he would expect the teenager to substitute for him to make up for the time he was having off. The teenager happily agreed to the arrangement and promised that, apart from the time when trial was taking place, he would devote himself full-time to his work with the swimming club and the leisure centre.
After leaving Brian, Luke walked home and told his parents about the latest development and was pleased to get their wholehearted agreement to give Jake the support he needed at the next hearing. In response to Scott's dinner invitation, Robert said that he would choose somewhere for the evening. In the end, everyone found the restaurant that had been selected was an ideal choice. Over the meal, Scott thanked Robert and Molly for their continued support for his son and for finding such an amenable boss for Jake to work for. He added that he and Jake had spent a great time together during the day, something they rarely got the opportunity to do. They had also discussed whether Jake would attend the hearing at the end of the week and Jake had decided that he wanted to go and hoped that Luke and his family would go as well. At the end of the evening, everyone returned home relaxed and full of food. Scott said that he did not want a late night as he had an early start the following morning for his flight to Amsterdam. Luke and Jake asked if they could go with him, but Scott pointed out that he had a hire car, and the teenagers would have a difficult journey back from the airport. Noting the sad look in Jake's face, Robert stepped in and said that he would be happy to follow in his car and bring them home.
Luke and Jake lay in bed together cuddling and kissing. In between long smoochy kisses, Jake told Luke that he and Scott had agreed that they should take a short break in America in the spring. Luke was delighted to hear this news and said how much he was looking forward to seeing the other members of Jake's family very soon. Because they had to be up early, both teenagers tacitly agreed that they should curtail any sexual activity and spent a relatively short time wanking each other off before lying back and going to sleep.
The following morning was very rushed as both dads were keen to make an early start for the airport. By mutual agreement, Jake travelled with Scott and Luke shared the ride to the airport with Robert. At the car hire office, the American returned his car and then `goodbyes' were said on the pavement as Scott waited for the bus to take him to his terminal. Robert, Jake and Luke stood watching the transport disappear, waving their hands even though there was little chance that the gesture would be seen. Although the atmosphere in the car on the ride back was subdued, there was repressed excitement at the prospect of Luke and Jake's early return to America in a few weeks.
The week leading up to the Court Hearing passed relatively uneventfully except for a chance meeting between Luke and George Smithers, who told him that he was planning a reunion evening for students that had left school the previous summer.
`I do hope you can both come, there's quite a lot of guys coming back especially, and I know they'd love to see you both.'
Luke replied by telling George about the upcoming hearing and the plan to go to America in the Spring. Nevertheless, he made a note of the details and promised that he and Jake would make every effort to attend.
Because they were nervous about the hearing, neither Jake nor Luke ate much less than their usual breakfast. Accompanied by Robert and Molly, they went to sit in the gallery to await the case being called. After a few minor cases had been heard, the three young men accused of assaulting the American teenager were brought into the Courtroom. Jake saw the supermarket manager and his family sitting at a different part of the public gallery and studiously avoided any eye contact. The defendants also refused to look around the Court and stared steadfastly at the floor until eventually the Clerk read out the charges. Each of the three young men were asked how they pleaded to the charge of Sexually Aggravated Assault causing actual bodily harm. There was a gasp of surprise as each answered `Guilty' to the charge. Robert immediately realised the implication of the pleas, namely that there would be no trial and Jake would not have to give evidence or relive the attack in a Courtroom. Jake responded with a grim smile and a nod.
It was obvious that the guilty pleas had caught everyone by surprise, but the Magistrate quickly recovered,
`I am sure that everyone is grateful to you three defendants for sparing everyone a trial, but you have all pleaded guilty to a very serious charge, one which inevitably will require a custodial sentence. You will be referred as soon as practical to the Crown Court where you will be sentenced. I must warn you that you should prepare yourselves for a lengthy period of imprisonment. Because of the nature of your crime and your plea, I remand you in Custody until a suitable date is found for sentencing. In the meantime, Court Officials will prepare pre-sentencing reports and a Victim Impact statement. Take them down.'
Without looking at anyone, the trio of defendants disappeared back to the cells. The ashen-faced supermarket manager left the Court without looking at Jake, although his younger son, Peter, did give a brief nod in the American's direction.
Claire Robson was waiting for Jake and his party in the foyer, she was smiling broadly and said,
`Well, that was some result! Took us all by surprise! I don't expect there to be a long delay before sentencing so I need to talk to you about whether you wish to make a Victim Impact statement and whether you want to give it in person or in writing. May I come around to see you later today? It won't be for long, I'd just like to explain the sort of things that should be included and, of course, you might decide you don't want to make any statement at all. The decision is entirely yours.'
Jake looked to Robert and Molly for guidance before replying. Robert said quietly,
`Later today should be okay. I'm sure Jake will want to absorb what has happened and we'll discuss the next stage with him over lunch. Hopefully we can also have a chance to speak to his family in America.'
`That's fine. Give me a call at the Police Station as soon as you are ready.'
Jake and his supporters managed to escape from the Court without being seen, even managing to avoid the ever-persistent news reporter Cindi Regan.
Once back home, Jake wasted no time in contacting his family with the news and asking for their advice. He told his mom and dad that he was minded to write a statement and to read it in Court. The message he received back was supportive and encouraging and so, armed with this reassurance and the support of his boyfriend, Luke, and Molly and Robert, Jake telephone the local Police Station and arranged for Claire to come around to talk him through the procedure.
The Victim Support Officer came to the house in the late afternoon and seemed pleased to hear Jake's decision. She offered some advice about what should be included and added that although he seemed determined to appear in person to read the statement, Jake could change his mind at any point. Having listened to what the Police Officer said, the American teenager expressed his determination to carry through with his decision and intended to start work on what he wanted to say as soon as possible so that it would be ready for whenever the sentencing hearing was scheduled.
Luke and his parents tactfully left Jake to compose his statement on his own, only offering comments or suggestions when asked to do so. The same was true of Scott and Kate in America, who expressed every confidence that their son would be more than capable of expressing himself. When the final version emerged and Jake read it to both sets of parents and Luke, they listened in silence appreciating the importance of what he was saying. Everyone was impressed by the American's remarks and made no suggestions for changes offering only praise and encouragement for his effort. Satisfied that he had done his best and that what he said needed no improvement, Jake submitted his statement to the Court and reaffirmed his intention to read it in person.
Notification of the Sentencing Hearing came quicker than might have been expected and, a few days later, Jake, Luke, Molly and Robert were waiting nervously at the entrance to Chamber. When the American teen walked in, he saw the defendants in the dock but none of them made eye contact. There was a further period of anxious waiting as the barristers for the Crown and Defence made submissions to the Judge. Finally, it was Jake's moment to speak, and he took out a typed copy of his statement and began to read in a clear and determined voice.
`Until the night that I was attacked, I have lived happily in England, first with my parents and, more recently with my boyfriend, Luke, and his parents, after my own mom and dad returned to America because of my dad's job. I was fortunate that I settled in well with the school system here and with the help of Luke and others I had a successful year and gained the qualifications necessary to enter University in this country. The original plan was for Luke and me to go together to London University, but my boyfriend suffered a severe illness a few months ago and so we decided to postpone for a year. We wanted to earn some money for when we start our studies later this year.
`I was fortunate that my dad was able to give me a job at his place of work before he left the country, and I continued to work there until the end of the year. I decided to leave that placement because of travelling difficulties and was successful in getting a job in the local supermarket which was closer to where I was living. It appeared to me that I was doing okay and had fitted in well despite the lack of a clear shift pattern which made social life difficult.
`All that changed on the night I was attacked. I was brutally attacked, knocked off my bike and kicked and punched to the extent that I suffered broken ribs and a broken arm. Of course, these injuries have more or less healed, but the psychological effect of the attack will take longer to recover from. I want to place on record my thanks to the young couple that intervened and stopped me suffering even more serious physical injuries and ensured that I received the medical treatment that I needed very promptly. I also want to thank the Emergency Services for their prompt treatment of my injuries and the investigation of my case, along with the doctors in the Emergency Room.
I do not wish to speculate on whether the attack was motivated by homophobia or just opportunism. I believe that is a decision for the Court. However, I was particularly shocked when I learnt that one of my attackers was a co-worker from the supermarket and someone that I had come to regard as friendly -- we had even been to the pub together even though I don't drink alcohol. How wrong I was!
The effect of his betrayal and the attack in general has been something I have still to come to terms with. For example, I no longer feel safe being out on my own at night. In addition, I am finding it hard to accept people as friends even when I know their intentions are honourable and well-meaning. I am working my way through this with the assistance of my parents, and Luke and his parents along with real supportive friends I have made in the past. It will take time, but I am determined to banish this nightmare from my mind and go on to live a fulfilling life.
`Thank you.'
The Court was silent for a moment and then the Judge thanked Jake for speaking so well. Even the young men in the dock looked up and watched as Jake returned to sit alongside his boyfriend.
The Judge next turned his attention to the defendants,
`Stand up! You have all pleaded guilty to the charge of assault. The details of the attack are horrendous and as Mr Jake Johnson, the victim, has told the Court, their effects are continuing to affect his life adversely. I am sure we would all want to hope that the recovery will eventually be complete.
`We have heard that there have been other similar attacks in the area, but none as vicious as this. We have also heard submissions from the Crown and the Defence Counsel as well as other reports. I have read the reports of the various agencies that have an interest in this case, and it is clear to me that the greatest influence over the group was that of the defendant MacPherson. The other two members of the trio, however, also share considerable responsibility for what occurred. I am particularly concerned by the involvement of Mr Johnson's co-worker, Charlie Green, whose betrayal has been ably described in the Victim Impact Statement. Before sentencing, however, I have taken into consideration the comments by the Defence barrister about this being the first offence for each of you and the character witness statements.
`Even though this may be the first time the defendants have appeared in Court, and they have entered guilty pleas at an early stage, thus sparing their victim the further trauma of having to re-live the attack, the charges to which the defendants have pled guilty are extremely serious. Furthermore, I am forced to the conclusion that the attack was, in part at least, aggravated by homophobia. Therefore, given the seriousness of the offence I have found it difficult to avoid making a custodial order in respect of all three of the defendants.
`Calum MacPherson, you were undoubtedly the ringleader of the gang, and I sentence you to imprisonment for 30 months after which you will be placed on Probation for 5 years from the date of your release.
`Charlie Green, you were pretending friendship towards the victim and your betrayal of that understanding adds to the seriousness of what you have done, you, too, will go to Prison for 30 months and will be placed on Probation for 5 years after your release.

`Joey Burns, although you are the most junior of the defendants, nevertheless, you were a willing participant in the attack and cannot therefore escape your share of responsibility. You are sentenced to 24 months detention in a Young Offenders Institution and will be placed on Probation for 5 years after your release, two of which will be suspended.
`Finally, I order all three of the defendants to pay compensation to Mr Jake Johnson in the sum of £1000 in the case of MacPherson and Green and £500 in the case of Burns.
`In bringing this Sentencing Hearing to a close I would wish to place on record the Court's appreciation for the young couple, known only as Tom and Lucy, whose important intervention not only ended the brutal attack, but also ensured that the Police and Ambulance services arrived promptly. The Court commends bot Services for their prompt initial response. I would also like to thank the Police for their effective handling of the investigation into the case and the speed with which they apprehended the culprits. They should be justly proud of their efforts. Finally, I wish to commend Mr Johnson for his bravery in coming to the Court to give his Victim Impact Statement in person.
`Take them down.'
For a moment there was a shocked silence in the Courtroom as the full impact of the sentences was being absorbed. The families of the defendants glared angrily at Jake and Luke and the British teenager's parents. The American was still trying to take in the sentence and the compensation order. As he stood there, Claire Robson bounded over and said,
`You were very brave, and I hope your words have an impact more generally than just in the Court.'
Jake was still shell-shocked and said quietly,
`So, what happens next?'
`Well, firstly, the three convicted men will be transferred to an appropriate institution. I expect that they might well appeal against the severity of the sentence and the level of compensation, but in many ways the Judge acted within guidelines so the question of whether they will succeed could be in doubt.'
With Claire on one side and Luke, Molly and Robert on the other, Jake walked out of the Courtroom. Immediately, Cindi Regan appeared anxious for an interview. Robert Townsend stepped into her way and said,
`Just at this moment, we are all still absorbing the outcome of the case. I think it would be reasonable to give Jake some space. I know he has spoken to you once before and I am sure he will be happy to talk to you again but not today.'
When they reached the outside there was another scrum of people waiting and the group needed Police assistance to push through the crowd so that they could get to their car. As he stood by the car door, Jake turned to the people that had crowded around and said,
`I am still absorbing what has just happened. I hope that you will respect my desire to have a short while for myself. I will issue a statement tomorrow morning. Thank you.'
There were a few people shouting remarks at the young American, but he quickly closed the door, and Robert drove away as fast as he could and took everyone home.
Once back at the house, Jake and the others had a quiet and slightly subdued dinner. There was no great feeling of elation but rather one of relief that the case was over and everything could start to return to normal. Molly had prepared the American teenager's favourite dinner, after which he said he thought he would make a start on his statement for the press. Luke waited for a moment before joining him but was reassured when his boyfriend indicated that he was happy for the British teen to join him.
The two boys worked on the statement which they agreed should not be too long. After several drafts, Jake eventually came up with a form of words that he found satisfactory.
`I am grateful that the nightmare that I have been living over the past few weeks is finally over. I again want to thank the young couple that intervened during the attack and not only saved me from a much greater degree of injury, but also called the Emergency Services which ensured I received the treatment I needed quickly. I am also grateful that I was spared having to re-live the event by the perpetrators pleading guilty. I hope that they will learn a salutary lesson whilst in custody, but I also want to wish them well for when they are released and are, hopefully, better people. I would like to take this opportunity to thank the local Police Force for the way in which they handled the investigation of the case and my Victim Liaison Officer, Claire Robson, for her help. Finally, I want to thank my two families, the one here and those in America for all their love and support through this difficult time. I look forward to returning to a more normal and quiet life where I can fulfil my hopes and dreams soon.'
Molly and Robert heard the statement and said that they thought it was excellent. They also agreed when Jake said that he had arranged to meet Cindi Regan the following morning for an interview as he had promised. Then, as he was tired, Jake said he wanted to go to his room and sleep.
When they were once again alone, Luke pulled his boyfriend into a hug and said,
`I want you to know how much prouder I am of the way you have behaved ever since the attack than I was before. I love you and it's an honour to be your boyfriend. Your dignity and words in Court were awesome and so is you press statement.'
The teenagers kissed passionately, and Jake mumbled quietly in reply,
`Thank you! I couldn't have done it without your loving support and that of my families. I will love you forever!'
Without a further word, the two lovers undressed each other and spent some time kissing before Jake broke away and allowed his lips to travel down Luke's torso. However, one area that the reporter wanted to explore further was the events that surrounded the end of the attack. Jake had again expressed his thanks to the couple whose intervention had saved him from more serious injury. Cindi was keen to follow this point up,
`You have mentioned several times that you feared that without the intervention of the young couple you might well have suffered even more serious injuries, so, tell me, just how scared were you?'
Jake hesitated and appeared on the point of refusing to answer. However, despite his obvious distress, he eventually decided to respond,
`Cindi, I genuinely feared for my life. They were taking it in turns to punch and kick me as hard as they could with blows landing mainly on my body. However, I could feel the strength I was using to defend myself ebbing away with every blow and I feared that they would soon be able to land blows around my head. At the worst moments I honestly thought I might die.'
`I can see that it must have been terrifying! Presumably you are better now, and your wounds are healing?
`Physically yes, but as I said in Court the psychological damage that the attack did has been to make me frightened to be out at night on my own and to be wary of people offering friendship. It will take a while for that to heal.'
Finally, Jake, how do you feel about the people that attacked you and the sentences they received?'
The young American paused for a few seconds before answering,
`In an ideal world I would not wish imprisonment on anyone. But we don't live in such a world. The people that attacked me deserved to be punished and I think I should rely on the wisdom of the Judge in setting the jail terms. I'm sure some people may consider them harsh but against that there were aggravating factors.'
`Thank you for talking to me, Jake. I wish you a complete recovery from all your wounds and hope that you and Luke enjoy life as University students.'
Jake nodded and said politely,
`Thank you, ma'am.'
Just as the interview was finishing, Luke emerged from the changing rooms and Cindi waited for a moment so that she could greet him.
`Hi, Luke, You look to me as though you are almost back to normal, which is great.'
`I'm getting there, Cindi, but there are still difficult days, but none as difficult as the ones that Jake has had to deal with over the last weeks.'
Cindi turned back to Jake and again thanked the American teenager for the interview and wished both him and Luke the very best of luck at London University.
After Cindi left, Luke and Jake went to the café in the leisure centre and had a quick lunch before the British teen returned to his coaching duties and his American boyfriend cycled back home. The arrangement they had come to was that Luke's dad would drive Jake to the centre where they would pick up Luke and then he would drop both boys off at the reunion party. When they arrived, Luke was already changed and waiting at the door. Robert drove the pair as close as he could to the pub and, before they got out, reminded them to call him when they were ready to go home. Before driving away, Luke's dad watched as his son and Jake walked inside the pub.
Having bought themselves a soda, the pair were directed to a private room at the back of the pub. As they entered, the conversation stopped, and a loud cheer broke out. A smiling George Smithers walked across and hugged each of them in turn,
`So really glad that you could make it. We were all delighted by the outcome of the Court case but it's time to put that on one side for at least this evening. I'm sure you know most of the people here so come on in and party!!!'
Several of the other guests were, indeed, well-known to the pair as they had shared classes with them but others they only recognised from brief meetings in the Senior School Common Room. It was not long before Luke and Jake were separated and swallowed up by the crowd. Although he was anxious at first, Luke quickly realised that, for the first time in a long time, Jake seemed relaxed and happy as he chatted to the people that had gathered around them.
Luke was walking over to join Jake when he felt a tap on his shoulder and turned to see a familiar face,
`Hi, mate, I hear you're going to London Uni in October now that you are recovered from that illness you had.'
`Hi, Bob, how are you doing?'
`I'm working for my dad, you know, keeping the Slater and Sons business in the fine condition he hopes it will always be. I hear that Jake is working for one of our firm's rivals, Joe McEnery.'
`Yes, temporarily until we go to London. I've got a job at the leisure centre as a swimming teacher and coach for the swimming club. Funny, I haven't seen you down there recently.'
`Nah, I lost a bit of interest to be honest, especially after you and Jake got together.'
Luke stared at his friend for a moment and then replied,
`W ... what do you mean?'
`Oh, you must have known I had the hots for you, but you only had eyes for Jake who's a very lucky fella in my opinion.'
`Bob, I never realised and I'm sorry but even if I had you're not really my type, sorry again.'
`No dice, mate, I found someone else and he's as butch as I am, and we get along great.'
`Is he here?'
`Nah, not really his scene. He's surprisingly shy in company especially where he doesn't know anyone. I'm not staying long but I really wanted to catch up with you. I hope we stay in touch and if Adam and I ever come to London, I'll expect you and Jake to show us the sights!'
`Of course, it'll be a pleasure!'
Well, say hi to Jake but I'm leaving now, you know people to do and all that.'
Luke gave a tentative laugh before he was enveloped in a massive bear hug after which Bob gave a general wave to the other guests and slipped out of the door.
Jake, who had been watching the exchange from across the room, came over and said,
`So, did your reunion with your former beau go well?'
Luke stood with a puzzled look on his face and said,
`What do you mean? He was never my beau, I only had eyes for you.'
Jake gave a sly grin and replied,
`I'll believe you, this time! For a very intelligent person, Luke, you can sometimes be quite dumb. Everyone in our group knew he was after you. How come you didn't realise?'
`I guess because once I saw you and knew you were the one, I didn't pay attention to anyone else.'
`You say the nicest things.'
Jake reached out and drew his boyfriend into a close hug and kissed him passionately.
Seeing what was happening, George shouted,
`Get a room, you two!!'
Realising where they were, the two lovers separated and looked around the room with an embarrassed smile on their faces.
The rest of the evening returned to normal with brief conversations, dancing and drinking continuing until people began to start leaving. It was getting quite late, and Luke was anxious not to keep his parents up too long so he called home, and his dad said he would collect them very shortly. Jake was still not fully recovered from his injuries and was pleased to be going home.
Before everyone left the party, George called for silence and said,
`Thanks for coming. I hope we can do this again in a few months, hopefully during the Easter holidays. I'm going to try to round up a few more people. If you know anyone who might be interested just let me know. Thanks again.'
At the door, Luke and Jake shook hands with George and several other guests and thanked them for the invitation and expressed the hope that they would be able to attend in the future.
When they got home and had retired to their room, Luke said,
`You really enjoyed tonight, didn't you?'
`I sure did. For the first time in a while I really felt safe and secure going out. I also enjoyed your embarrassment over Bob and his infatuation with you. You can be so blissfully unaware at times, it's funny!
`Well, thanks for that!'
`Only joking, but I'm still looking forward to going back to the next get together. Also, it was sad that neither Ahmad nor Mike was there, perhaps we should try to get them along next time too or maybe it's time for us to visit them in London, I'd like to see the flat we'll be living in later in the year.'
`Ahmad was invited this time but couldn't come because Nick was coming home from his theatre tour this weekend, but he probably will be free to attend the next one. As you know, Mike didn't go to our school, but I'll talk to George and see if he would mind if he came. I agree with you, I think a visit to London would be great, even if only for the day. Now, are we going to get into bed and then I'll show you that you are the only one for me.'
Jake grinned broadly and leapt into bed holding the covers back so that his boyfriend could join him.
